What does this mean?
To maintain public safety and order at a declared public event or place, police can:
If you are subject to any of the above, you are legally required to comply with the officer’s direction.
What are the maximum penalties involved?
A person who is ordered to leave a declared public event, place or vehicle, but remains, re-enters, or attempts to re-enter, within a 24-hour period is guilty of an offence which carries a maximum penalty of $1 250.
A person who uses or carries a prohibited weapon is guilty of an offence which carries a maximum penalty of $20 000 or imprisonment for 2 years.
A person who carries an offensive weapon is guilty of an offence which carries a maximum penalty of $2500 or imprisonment for 6 months.
A person who, without lawful excuse— (a) carries an offensive weapon or an article of disguise; or (b) has possession of an implement of housebreaking, is guilty of an offence. Maximum penalty: $2 500 or imprisonment for 6 months.
Why were these laws introduced?
Declared public events and places have been introduced to maintain public safety and prevent incidents involving knives and other weapons.
Changes to the Summary Offences Act empower police to conduct metal detector searches in declared public events, areas, and vehicles, aiming to detect and deter threats before they occur.
Police are also authorised to direct individuals or groups to leave an area or vehicle if they pose a risk to public order and safety.
